1. Who you are contracting with

SiteDesk is operated by Razin Omar ("we", "us", "the seller"). By creating an account or continuing to use SiteDesk, you agree to these Terms & Conditions and enter into a contract with Razin Omar. If you use SiteDesk on behalf of a company, you confirm you have authority to bind that company; if you use it as an individual, you confirm you are of legal age.

2. The service

SiteDesk is an AI-assisted tool for small contractors. From a short job brief it generates a "job pack": a quotation, materials list, labour estimate, job schedule, invoice draft, customer message, and service report. We grant you a limited, non-exclusive, non-transferable right to use the service within the plan you subscribe to.

3. AI-generated content — your responsibility

SiteDesk uses generative AI. Outputs may be inaccurate, incomplete, or unsuitable for your specific job. You are responsible for reviewing and verifying every quotation, price, materials list, and estimate before sending it to a customer or relying on it. SiteDesk outputs are not professional engineering, legal, or regulatory advice and must not be used as a substitute for qualified oversight where required.

You must not use the service to generate content that is unlawful, fraudulent, hateful, or infringing, nor attempt to bypass or "jailbreak" the AI's safeguards. You are responsible for your inputs and must have the rights to any content you submit. We may remove or restrict content, refuse or filter outputs, and suspend accounts that violate these rules. Rights holders may contact us to request takedown of infringing material; repeated infringement leads to termination.

You retain ownership of your inputs. As between you and us, you own the outputs generated for you; you grant us a limited licence to host and process your content solely to provide the service.

4. Acceptable use

You must not misuse the service, including:

• using it for any unlawful purpose, fraud, or spam;
• infringing intellectual property rights;
• interfering with security — introducing malware, probing, scanning, or scraping the service;
• reverse engineering, reselling, or redistributing the service, or circumventing plan limits;
• sharing your account credentials. You are responsible for all activity under your account.

You must provide accurate information and keep it up to date.

5. Payments, subscriptions, and refunds

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

Subscriptions renew monthly until canceled. Payment, billing, tax, cancellation, and refund mechanics are governed by Paddle's Buyer Terms. See our Refund Policy for how to request a refund.

6. Intellectual property

We retain all ownership of the service and its intellectual property — the software, documentation, and SiteDesk branding. These terms do not transfer any of it to you.

7. Service level and warranties

We do not guarantee uninterrupted or error-free performance. To the fullest extent permitted by law, the service is provided "as is" and we disclaim all implied warranties, including merchantability and fitness for a particular purpose.

8. Liability

To the fullest extent permitted by law, we are not liable for indirect, consequential, or special damages — including loss of profits, data, or goodwill — arising from your use of the service, including reliance on AI-generated quotations or estimates. Our aggregate liability is capped at the fees you paid in the 12 months before the claim. Nothing in these terms excludes liability for fraud, death, or personal injury where the law does not allow it.

9. Suspension and termination

We may suspend or terminate your access for material breach, non-payment, security or fraud risk, or repeated or serious violations of these terms. When your access ends, your job data may be deleted after a reasonable period; export anything you need before closing your account.

10. General

These terms are governed by the laws of Singapore, and the courts of Singapore have jurisdiction over disputes. You may not assign these terms without our consent; we may assign them in connection with a merger or acquisition. We are not liable for failures caused by events beyond our reasonable control. We may update these terms from time to time; continued use after an update constitutes acceptance.
